Special Education Law |
|
| |
Being proactive and consulting with a special education attorney before disputes arise can save parents a lot of aggravation. At Special Kids Law Center, LLC we offer special education consultations, advocacy services and Individual Education Plan (IEP) planning strategies. Although we encourage all parents and school officials to use negotiation to resolve disputes regarding the education of a child with disability, sometimes litigation is inevitable. At Special Kids Law Center, LLC we also offer legal services regarding IDEA and Section 504 issues, from negotiation to mediation and, if need be, due process hearings and appeals. |

Guardianships |
|
| |
The law presumes that individuals over the age of eighteen are
competent, and therefore able to make their own decisions about
what is in their best interest. Unless a guardian is appointed for
the child with a disability after their eighteenth birthday, that
child will have to carry the burden of making his or her own decisions
about their future, personal and financial, regardless of the severity
of his or her disability. At Special Kids Law Center, LLC we offer
legal services to create the legal relationship that enables the
qualified to act on behalf of the unqualified, however limited or
broad the need. |

Estate Planning |
|
| |
Estate Planning is not just for the wealthy, it is a necessity for parents with special needs children. Most parents of children with special needs are well versed when it comes to their child’s government benefits. However, what many parents don’t often think about is the effect that their own estate plan can have on their child’s benefits. Without proper estate planning, special needs children could lose government benefits upon which they rely. Therefore, it is essential that you prepare an estate plan that will take into account your child’s unique circumstances. At Special Kids Law Center, LLC we can guide you through the estate planning process and create an estate plan today that will provide for your child’s tomorrow. |

Special Needs Trusts |
|
| |
The Special Needs Trust (SNT) is the most useful estate planning tool available to provide financial security for a child with a diability. The SNT is developed to manage resources while maintaining the child’s eligibility for government benefits. For example, SNTs are usually developed to preserve the public benefits for the disabled child receiving those benefits who then receives an inheritance or receives proceeds from a personal injury settlement or lawsuit. Thus, it is important that families consult an experienced attorney who is familiar with the stringent rules and regulations placed upon SNTs. At Special Kids Law Center, LLC we can help create a comprehensive plan for the disabled child and quality SNT to maximize his or her benefits. |
